Recently, the Mexican Institute of Industrial Property (IMPI) published the Declaration of Protection of the Geographical Indication, Wines of the Wine Region of Querétaro in the Official Gazette of the Federation. This Declaration is the first to be published this year. Furthermore, it is the first issued Mexican Geographical Indication to identify an alcoholic beverage.
The IMPI declared the Protected Geographical Indication for “Wines of the Wine Region of Querétaro” in the aforementioned publication to identify an alcoholic beverage consisting of the alcoholic fermentation solely of fresh grape musts, with or without pomace, or a mixture of concentrated grape musts.
The Declaration establishes the Protected Geographical Indication, “Wines of the Wine Region of Querétaro,” as a national asset which may only be used by means of an authorization issued by the IMPI once the legal entity responsible for the certification of compliance with the rules of use is accredited and meets the requirements established in the Federal Law for the Protection of Industrial Property.
In addition, anyone interested in being an authorized user of this geographical indication will be required to use the Protected Geographical Indication, “Wines of the Wine Region of Querétaro,” as it appears in the Declaration, as well as to apply the legend “Protected Geographical Indication,” or the initials “P.G.I.”, to the protected product.
The validity of the Declaration of Protection will be determined by the continuing conditions that motivated its publication, and it will only cease to be valid if the IMPI issues another declaration to such effect.
The IMPI will carry out the corresponding procedures related to the international recognition of the Protected Geographical Indication, “Wines of the Wine Region of Querétaro,” in accordance with the international trade treaties and agreements in force for Mexico.
