The Mexican Institute of Industrial Property Amends the Guidelines of Its Advisory Council

October 21, 2026

On October 6, 2026, the Mexican Institute of Industrial Property (IMPI) published in the Official Gazette of the Federation the Agreement amending the Guidelines of the Advisory Council of the Mexican Institute of Industrial Property. These amendments were proposed by the Council itself and approved by a majority of its members at the meeting held on September 18, 2026. It should be noted that this Council has been in operation since February 2025.

The main changes to the Guidelines are:

  • Creation of the Vice Presidency. This position is held by the head of IMPI’s General Directorate. The Vice President’s duties will consist of supporting the Presidency in the strategic leadership of the Council, following up on its resolutions, coordinating with IMPI’s departments to address recommendations, proposing working groups, evaluating results, and preparing annual reports. The Vice President has the right to speak and vote, except on certain types of matters and proposals related to IMPI’s work plans and programs.
  • Broader Scope. The Council may issue recommendations, suggestions, proposals, and opinions on general industrial property matters, and no longer only directed to IMPI. Its advisory nature is maintained, as its pronouncements are not binding on the Ministry of Economy, IMPI, private individuals, or other members of the intellectual property system.
  • New Composition. The Council is composed of the Presidency, the Vice Presidency, fifteen council members from the private sector, civil society, and academia, and a Technical Secretariat. The Technical Secretariat has only a voice and is held by the head of IMPI’s Divisional Directorate of Legal Affairs.
  • Operations. Ordinary meetings will be held twice a year, with the schedule proposed by the Vice Presidency. The minutes will be signed by the Presidency and the Vice Presidency. Annual reports will be approved at the first ordinary meeting of the following year and submitted to the Ministry of Economy. Notifications and calls for meetings will be made via a microsite to be set up by the Institute.

The Agreement will enter into force on the business day following its publication, that is, October 7, 2026.

Through these amendments, the Council will be able to engage more directly with IMPI’s operations and offer its views on public policy issues related to industrial property in general, thereby creating an opportunity for businesses, academia, and civil society to influence the agenda of this important sector.
