Amendment to IMPI´s First Response Deadline for Procedures regarding Appellations of Origin and Geographical Indications

October 7, 2026

On September 4, 2026, the Mexican Institute of Industrial Property (IMPI) published an Agreement amending the regulations establishing the deadlines for first responses to various proceedings before the IMPI, particularly those related to appellations of origin and geographical indications. The amendment adjusts certain procedures and establishes a new procedure for the accreditation of legal entities responsible for certifying the rules of use for protected geographical indications, which recycles a previous reference code with the same number.

The relevant changes in the Agreement are:

  • The procedures identified by reference numbers IMPI-01-007, IMPI-01-014, and IMPI-2019-040-013-A have been amended.
  • Reference number IMPI-01-019 has been recycled, now being used for the application to receive accreditation as a legal entity responsible for certifying the rules of use for protected geographical indications, with an initial response deadline of 45 business days.
  • Reference number IMPI-01-008 in Article 3 of the amended Agreement has been repealed.
  • The title of Chapter VII of the Agreement is amended to specifically include the application to modify a declaration of protection for a national appellation of origin or geographical indication.
  • Article 25 is amended so that when an application for a declaration or registration is subject to opposition, the IMPI shall have a maximum period of five months instead of six to issue a corresponding decision, starting as of the end of the period established in Article 286 of the Federal Law for the Protection of Industrial Property.

The deadlines for the first responses are now as follows:

Reference Code Procedure First Response Deadline
IMPI-01-007 Authorization or renewal of authorization to use a national appellation of origin or geographical indication. 30 business days
IMPI-01-014 Registration of the agreement authorizing the use of a national appellation of origin or geographical indication. 30 business days
IMPI-2019-040-013-A Application to convert an application for the declaration of protection for an appellation of origin to a national geographical indication (or vice versa). 3 months
IMPI-01-019 Application for accreditation as a legal entity responsible for certifying the rules of use for protected geographical indications. 45 business days

The Agreement enters into force on the date of publication in the Official Gazette of the Federation. Applications filed prior to its entry into force must be processed in accordance with the regulations in effect at the time of filing.

This amendment is relevant for users, producers, certifying bodies, and holders or other parties interested in the rights related to appellations of origin and geographical indications. Note that the timeframes for IMPI’s administrative actions have been updated, thus providing predictability for procedures related to authorizations of use, agreements, amendments to applications, accreditations, and proceedings subject to opposition.
